These Terms of Use (the “Terms”) are a binding agreement between you and Caliber Peptide Index (the “site”, “we”, “us”). By accessing or using the site, you agree to these Terms in full. If you do not agree, do not access or use the site.

Eligibility

You may use the site only if you are at least 21 years of age, are accessing the site in connection with legitimate scientific, educational, or professional research, and are legally permitted to view this information and to purchase, possess, and handle research compounds in your jurisdiction. By using the site you represent and warrant that all of the foregoing is true. You are solely responsible for determining whether your access to and use of the information here, and any subsequent purchase, importation, possession, or use of any compound, is lawful where you are located.

What the site is

Caliber Peptide Index is an independent directory and price tracker for research-peptide vendors. We do not sell peptides, do not stock inventory, do not process orders, and do not handle payments, shipping, or fulfillment. We are not affiliated with, and do not act as an agent of, any vendor we list unless explicitly disclosed. Listings and prices are compiled, in part by automated means, from information published by each vendor and other public sources.

Research use only — no medical advice

Peptides and other compounds referenced on the site are research compounds intended for laboratory research use only. They are not approved by the U.S. Food and Drug Administration or comparable regulatory bodies for human or veterinary consumption, and are not intended to diagnose, treat, cure, or prevent any disease. Nothing on the site is, or should be construed as, medical, pharmaceutical, veterinary, legal, or professional advice. The site does not recommend, endorse, or encourage the purchase or use of any compound for any purpose other than lawful research by qualified persons in appropriate settings. Always consult a qualified professional before acting on any information you find here.

Assumption of risk and your responsibilities

You use the site, and act on any information obtained through it, entirely at your own risk. You are solely responsible for complying with all laws and regulations that apply to you, including those governing the importation, purchase, possession, handling, and use of research compounds, and any applicable controlled- substance, customs, and export-control rules. You agree not to use the site or any information on it for any unlawful purpose or for human or animal consumption.

Third-party vendors and transactions

The site links to third-party vendor websites that we do not own or control. Any purchase or other transaction you enter into is solely between you and the vendor. We are not a party to those transactions and are not responsible or liable for:

• the quality, purity, safety, legality, or authenticity of any vendor’s products;
• the accuracy of certificates of analysis (COAs), lab results, or product claims made by vendors;
• pricing, payment processing, taxes, order fulfillment, shipping, delivery, returns, or refunds;
• any vendor’s conduct, customer service, privacy practices, or compliance with law; or
• the content, products, or practices of any third-party site you reach through an outbound link.

Any dispute arising from a transaction with a vendor is strictly between you and that vendor. Inclusion of a vendor in the directory is not an endorsement, certification, or guarantee of that vendor or its products.

Accuracy, availability, and no warranty

Listings, prices, and descriptions are compiled in good faith, in part by automated collection, and may be inaccurate, incomplete, out of date, or wrong. Prices shown are not an offer and frequently lag the vendor’s actual pricing; always verify current price and terms directly on the vendor’s site before making any decision. The site is provided “as is” and “as available,” without warranty of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.

Affiliate and commercial relationships

The site may earn affiliate commissions when you click an outbound link and make a purchase on a vendor’s website, at no additional cost to you. Affiliate relationships do notinfluence whether a vendor is listed or where it ranks: inclusion is editorial and ordering on each peptide page is determined solely by price (lowest dollars-per-milligram). We do not accept payment for placement or ranking. Outbound affiliate links are marked with rel=“sponsored”, and a standing disclosure appears in the site footer.

Acceptable use

You agree not to: scrape, crawl, or harvest the site at unreasonable rates or in a manner that burdens our infrastructure; attempt to disrupt, probe, or compromise the site or its security; misrepresent your relationship to the site; use the site in any way that violates applicable law or the rights of others; or copy or republish substantial portions of site content without our prior written permission.

Intellectual property

Site copy, original compilations, and visual design are © Caliber Peptide Index. Vendor names, logos, and trademarks are the property of their respective owners and are used here for reference and identification (nominative fair use) only; their use does not imply any affiliation or endorsement. Brief quotation of, and linking to, the site for commentary, research, or news purposes is welcome and consistent with fair use.

Limitation of liability

To the maximum extent permitted by applicable law, Caliber Peptide Index and its operators, owners, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the site, any information on it, or any transaction with a vendor, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the site will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Caliber Peptide Index and its operators, owners, and contributors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the site; (b) your reliance on any information obtained through the site; (c) any transaction or dispute between you and a vendor; or (d) your violation of these Terms or of any applicable law or third-party right.

Binding arbitration and class-action waiver

Please read this section carefully — it affects your legal rights. Except for claims that qualify for small-claims court, any dispute, claim, or controversy arising out of or relating to the site or these Terms will be resolved by final and binding individual arbitrationadministered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Arizona, rather than in court. You and we each waive the right to a trial by jury and the right to participate in a class, collective, or representative action. Arbitration will be conducted on an individual basis only; the arbitrator may not consolidate more than one person’s claims.

Opt-out: you may opt out of this arbitration agreement by emailing [email protected] with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms. If any part of the class-action waiver is found unenforceable, the remainder of this section will still apply.

Governing law and venue

These Terms and any dispute arising from them or from your use of the site are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. To the extent any matter is not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

Changes to these Terms

We may update these Terms as the site’s operations change. The “Last updated” date at the top of this page reflects the most recent revision. Your continued use of the site after a change takes effect constitutes acceptance of the revised Terms.

Severability, entire agreement, and waiver

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the site and supersede any prior understandings. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the site.
